Preamble

The website https://www.ubidoca.com/_en/ is owned by UBIDOCA Company.

The company UBIDOCA (hereinafter UBIDOCA) is specialized in the reception, redirection and digitization of the postal mail.

UBIDOCA offers its services exclusively via the Internet.

UBIDOCA is a registered trademark of the INPI, the French National Institute of Industrial Property.

1. Definitions

The names used in these Terms and Conditions meet the following definitions:

  • Customer: any person registered on the website https://www.ubidoca.com/_en/
  • Customer area: personal secured space to which the customer accesses thanks to its identifier and password
  • Identifier: an e-mail address that allows the customer to identify himself and connect to his Customer Area

 

2. Objet: Applicability

These Terms and Conditions govern the use of the site https://www.ubidoca.com/_en/, as well as the services offered by UBIDOCA. They shall apply to any user of the site https://www.ubidoca.com/_en/.

These Terms and Conditions are valid as of March 1, 2013. This edition supersedes any previous version.

 

Article 1. Conclusion of contract

1.1. Territoriality

The services offered by UBIDOCA can only be contracted via Internet on the site https://www.ubidoca.com/_en/.

Therefore, any person domiciled in France or outside France can contract with UBIDOCA, subject to the application of differentiated rates for mailing.

Users of https://www.ubidoca.com/_en/ declare that they acknowledge the Internet capabilities and its limitations, including its functional and technical performance characteristics, namely the risks of interruption, the variation of response time needed to consult, query or transfer information, and any other kind of risk inherent to any connection on the web.

1.2. Ability to contract

Pursuant to article 1146 of the Civil Code, you (= the customer) declare that you have the capacity to contract under the conditions described below, that is to say being an emancipated minor or having the French legal majority (18 years old) and not being protected within the meaning of Article 488 of the French Civil Code.

You guarantee the truth and exactitude of the information provided to any UBIDOCA service.

1.3. Acceptance of the Terms and Conditions

You declare that you have read and accepted these Terms and Conditions when registering on https://www.ubidoca.com/_en/ by checking the box “I have read and accept UBIDOCA Terms and Conditions”.

The registration constitutes acceptance without any reservation of the present Terms and Conditions.

1.4. Formalization of contract

1.4.1. The principle

As soon as you register, you will receive a validation e-mail. This e-mail forms the sales contract between UBIDOCA and you.

UBIDOCA reserves the right to refuse providing a service ordered and / or paid online, with no need of justification, in case of manifest violation of moral or public order as understood by the French law. In this case, the credit you have funded will be returned to you within 8 working days since the detection by UBIDOCA of the abovementioned violation(s).

1.4.2. Free Trial

The free trial offer includes free scanning and uploading in your Customer Area of 10 pages of mail or 10 envelopes or a combination of the 2. In order to test our services, you may send yourself letters or envelopes. Under no circumstances this offer could include 10 pages of mail or 10 envelopes that you received from your correspondents.

You can ask us to destroy these test pages once scanned or to return them by mail in the stamped envelope that you will have provided us with the test letters.

This free trial is non-binding.

1.4.3.The welcome offer

The welcome offer consists of free online posting in your Customer Space of 10 pages of scanned mail or 10 scanned envelopes or 10 fax pages or a combination of the three within the 10 scanned pages limitation.

Since the faxes can be consulted in the form of a PDF document, they can only be consulted in their entirety. Therefore, if the number of pages of your welcome offer is less than the number of pages of your fax, you will not be able to view it unless you credit your account accordingly.

UBIDOCA reserves the right to refuse this offer without justification in case of manifest violation of moral or public order, in the case of suspicion of fraud or attempted fraud on the Internet, or Infringement of French legislation

The welcome offer does not apply to online gaming and betting mails (these will be scanned and deducted from the monthly quota of pages included in the customer's package or charged per unit if the customer did not subscribe to a package).

The welcome offer is suppressed when the customer's account has an overdraft (in particular when the customer has not paid for his package, his paid options, or his mail or parcel guards).

1.4.4.Electronic signature

Any ordering for a service offered on the site https://www.ubidoca.com/_en/ assumes the consultation and the express acceptance of the present Terms and Conditions by the customer. However, this acceptance is not conditioned by a handwritten signature on your part.

In accordance with the provisions of Articles 1316 to 1316-4 of the Civil Code, supplemented by Decree No. 2001-272 of 30 March 2001, adopted for the application of Article 1316-4 of the Civil Code and relating to electronic signature, It is recalled that the validation of your order constitutes an electronic signature which has, between the parties, the same value as a handwritten signature and is proof of the entirety of the order and the chargeability of the sums due in execution of the said command.

1.4.5. Evidence

It is expressly agreed that, unless you bring proof of a manifest error, the data kept in the information system of https://www.ubidoca.com/_en/ have probative force concerning the purchased orders.

The data retained by UBIDOCA over electronic or computerized support constitutes proof. If UBIDOCA files them during in any legal dispute or other proceedings as evidence, they shall be admissible, valid and enforceable between the parties in the same manner, in the same conditions and with the same probative force as any document which is established, received or retained of a physical support

 

Article 2: Services offered by UBIDOCA

The services offered by UBIDOCA can be found at https://www.ubidoca.com/_en/service.php.

2.1. Information relative to all services

Because UBIDOCA does not retrieve your mail directly from your mailbox, it is your responsibility to make sure that it is properly redirected to UBIDOCA.

2 options are at your disposal to send us your postal mail:

  • Or by subscribing a contract for redirection directly from La Poste (or your national postal service when it is relevant);
  • Either by informing your correspondents of your new address.

Your UBIDOCA address will be communicated to you by e-mail when you register. It reads as follow:

The mention "Centre UBIDOCA + customer number" is mandatory. Failing this, your letters and parcels cannot be identified as to be distributed to our address by the Post Office. In addition, the mention "Centre UBIDOCA " makes it possible to differentiate your UBIDOCA address from your Tax domicile. Under French law, which prohibits the domiciliation of natural persons, your UBIDOCA address does not constitute your tax domicile. In fact, UBIDOCA can address you only certificates of postal domiciliation and not proofs of residence. Issuing a certificate of postal domiciliation or a commercial domiciliation costs 5 € + postage charges.

If mail or parcels are sent to you without the mention "Centre UBIDOCA + customer number", a fee will be charged (1.50 € per envelope and 3,50 € per package). If the absence of this mention is recurrent and / or deliberately omitted, UBIDOCA reserves the right to close your account.

Your Ubidoca address is merely a mailing address. As a result, you cannot, under any circumstances, use it to :

  • issue a passport, identity card, resident card, car registration or insurance card;
  • to open a bank account (in a local or online bank) or to create a Bank card, check book, check remittance slip, etc.;
  • to apply for a loan or credit from a bank or a financial institution.

Neither can you provide this address in order to benefit of social assistance paid by the State nor any affiliated organization (public or private).

Random checks of your mails may be made by Ubidoca's management in case of suspicion of fraudulent / unauthorized use of your Ubidoca address. A management fee of 15 € will be charged to you whenever we have to write and send a letter to the administration or the organization concerned by the illegal use of our Ubidoca address.

The postal address that we provide to you cannot be used on online betting sites (PMU, Française des Jeux, Betclic, Winamax, Unibet, etc.). It cannot be used to open a Nickel account in a tobacco shop.

In order for UBIDOCA to receive your registered mail, you must first fill out the postal proxy form (form 776) which was sent to you by e-mail when you registered and send it back by e-mail or by mail along with a two-sided copy of your (valid) identity card. Otherwise, your registered mail will be refused and returned to the sender. A management fee for "refusal of registered mail" will be charged (€ 1.50 per registered mail refused). Ubidoca is not aware of the mail sender name in the event of refusal of registered mail.

2.2. Digitizing your mail

UBIDOCA digitizes your mails, except advertisements, books and magazines (unless explicitly requested otherwise).

Scanning quality is limited by default to 100 DPI. A higher numerical precision is available on request at an additional cost (please consult us in this case). Lower scanning precision is also possible on request (no increase or reduction of cost).

Documents larger than A4 are not scanned. In this case, an e-mail is sent to notify you of the non-scanning of the document.

Two-sided mail is counted as a 2-page mail (= 2 units). Traditionally redundant pages are not scanned (for example: back of certain bank statements or back of some telephone operator invoices).

In case of doubt as to the nature of a mail (full advertisement or documentation you may have requested), we send you an e-mail mentioning the sender of the mail in question and its format / volume; the digitization is carried out after agreement of your part.

When a mail exceeds 15 pages, UBIDOCA sends you an e-mail mentioning the sender of the mail and the total number of pages. The mail is not scanned in full until you have agreed to it. Whenever it is possible, the first page of the mail is scanned to give you an overview of the full mail.

If you do not want UBIDOCA to open your mail, "Quid" packages allow you to view only the envelopes received for you. You can then, through your Customer space, ask us to open the envelope and scan the contents of the envelope.

Depending on the day and time at which you make this request, the envelope is opened and digitalized on the same day or, at the latest, the next working day (excluding UBIDOCA closure).

2.3. The forwarding of your mails

If you have ordered one of our packages "simple forwarding without opening", your mails are received by UBIDOCA and stored.

You are notified by e-mail whenever we receive a mail for you; you are given the number of letters received, possibly the title of the magazine, or if the mail received is a registered mail.

Your mail will then be redirected to you by batch mailing (in a large envelope) according to the periodicity you choose: once a month, every 15 days, once a week or every day (working day).

The shipping costs (by Post or by private carrier) are not included in the packages since they vary according to the weight, the destination and the format of sending of your mails.

This provision for postage costs works as a prepaid credit: if it is not used in full for the current month, the balance is used the following month, and so on.

2.4. Other services

2.4.1.Receipt and redirection of packages

In order to repress fraud and scams on the Internet via our website and our company, the delivery - re-dispatch of parcels service is strictly framed. You must meet all of the following conditions. You shall:

  • Send a double-sided copy of your identity card by mail or e-mail
  • Communicate a forwarding address
  • Subscribe to a Simple Redirection Package
  • Pay for a 3 months advance plan + a provision to cover shipping costs
  • Pay before sending your packages, by bank transfer only

If, when receiving your package, one of these conditions is not met, you will be charged 48 hours after receipt of your package: 7 euros per week and per package. After 1 month of storage without payment or special instructions from you, the parcel will be returned to the sender with the NFTA mention ("not found at this address ") and without further postage stamps ( which means no guarantee of receipt by the sender). We will charge you 7 € per destroyed parcel if it cannot be returned to the sender (i.e. parcel delivered by private carrier).

The parcels are not opened and are redirected as is at the address indicated in your Customer Area. It is your responsibility to ensure that an invoice is accessible by customs without opening the package. Failing this, your parcel may be returned to us or opened for customs verification of the contents.

If Ubidoca is to re-package your package (damaged packaging, non-reusable packaging, etc.) so that it can be accepted by the postal services, you will be charged for re-packaging (5 euros per re-packaged parcel).

If you wish to aggregate several parcels in one package, you have to ask us by e-mail before receiving the first package to consolidate (cost: 5 euros of reconditioning). If Ubidoca has to store several packages for repackaging before shipment, you will be charged for storage costs (7 euros per package per week)

The parcels are redirected to you, by default, in “colissimo international recommandé” (rate of recommendation R1) the same day of their reception and to the address indicated in your Customer Area (provided that your Ubidoca balance is sufficient to cover all shipping). If your balance is insufficient, you will be charged for storage (7 euros per week and per package). If you want another type of shipment (in economic package, with a higher recommendation rate or via a private carrier), simply contact our Customer Service by e-mail and indicate your shipping preferences before receipt of your package. In this case, you will be charged an additional fee (in particular in the case of an economic shipment).

When Ubidoca receives your package, if customs fees or taxes are to be paid, your Ubidoca account must be sufficiently supplied to cover them in full. Failing this, your package will be refused. Ubidoca cannot make credit.

The 3-month mandatory subscription to one of our Simple Re-Delivery Pricing Packages as well as the shipping costs of your packages are payable in advance. No credit is granted by Ubidoca.

The 3 months subscription is due, regardless of the number of packages you will receive.

If you use our services to receive your mail and you do not wish to receive parcels, you must inform us by e-mail. You will be charged a fee each time we refuse a package (4 euros per package). If we receive a package before your request for refusal, the parcel will be redirected to you at your own expense without any possible contestation or returned to the sender on your request (if the return is possible).

2.4.2. Fax reception

Fax reception is possible within the framework of the "Fax reception by e-mail" pricing package or the "Internet mail" and "Selective opening" pricing packages.

Your fax number will be sent to you by e-mail after ordering one of the aforementioned packages and after your payment.

You are asked to ensure that your correspondents clearly identify you as the recipient of the fax. Failing this, UBIDOCA will not be able to send you the fax in question.

Your faxes are put online in your Customer Area upon receipt. You are notified immediately by e-mail.

Since the faxes can be consulted in the form of a PDF document, they can only be consulted in their entirety. If the number of pages on your balance account is less than the number of pages in your fax, you will not be able to view it unless you credit your account accordingly.

2.4.3. Payment of invoices

We can pay your bills on the basis of the original mails in our possession (or mails you may have sent us by e-mail). You can request it from your Customer Space by clicking on the "Pay Invoice" button located at the top of the scanned mail bearing the invoice.

We then debit your UBIDOCA account from the amount of the invoice and pay the UBIDOCA service (which is either included in your package or invoiced in addition) and 1.6% of the invoice amount; it is up to you to credit your account accordingly.

If your UBIDOCA account does not cover all of these costs, your bill payment will be put on hold until you receive your payment.

In order to pay your bills, your UBIDOCA account must be supplied exclusively by bank transfer or by check. Failure to comply with this condition, UBIDOCA can not be held responsible for any delay in payment.

2.4.4. The domiciliation

We can domiciliate your company (created or to be). The domiciliation of company requires the constitution of a prior files including:

  • A domiciliation agreement (in duplicate) signed and dated
  • A two-sided copy of your identity card (valid)
  • A postal proxy to receive your recommended mail
  • Proof of residence of less than 3 months
  • A handwritten document indicating:
    • the place where your accounts are kept
    • the place where your invoices are kept
    • your commitment to put these accounting documents at the disposal of the administration at the domiciliation address in the event of a tax audit (Mandatory even if you do not have an accountant and your business is not yet an invoice producer).

These documents must be sent to UBIDOCA as soon as possible by post or by e-mail at domiciliation service. Failing this, the domiciliation cannot be validated by UBIDOCA.

If you have completed the formalities for establishing or transferring the registered office without having communicated the above mentioned documents to UBIDOCA, the latter reserves the right to inform on the domiciliation thus made to the competent administrations.

UBIDOCA may carry out for you all or part of the compulsory formalities for the creation of a company or transfer of the registered office of your company:

  • Complete drafting or simple amendment of the statutes
  • Drafting and publication of legal announcement
  • Constitution and filing of your file with the Chamber of Commerce and Industry.
  • Complete follow-up of the file until the actual existence of your company or effective transfer of your registered office.

This service is subject of a preliminary estimate which you must return signed and dated, accompanied by the handwritten mention "bon pour accord" (= good for agreement).

No administrative steps will be taken by UBIDOCA before the receipt of your domiciliation contract and / or duly validated quotation.

Account opening fees are charged (15 €) for each new domiciliation (company or association). These fees are retained regardless of the outcome of the domiciliation.

The domiciliation service is granted and accepted for a minimum period of three (3) months renewable by tacit agreement by period of three (3) months from the date of your registration.

It may be revoked by either party without compensation at each 3-month deadline by means of a registered letter with acknowledgment of receipt, subject to a one (1) month notice.

The domiciliary undertakes to pay 3 months advance payment (by bank transfer only). These fees are not refundable. If the file of domiciliation is refused by the administration, the 3 months of advance paid to Ubidoca are not refunded.

The service of domiciliation includes, according to the packages, the establishment of your head office to our address, the digitization of your letters, the redirection of your original letters, the reception of faxes, legal and administrative assistance.

2.4.5. Legal and administrative assistance; mail writing and company creation

UBIDOCA can send a mail from France on your behalf, mail that you have previously sent us by e-mail. This service is included in your package or invoiced in addition; postal charges in all cases at your expense.

UBIDOCA can also write a mail for you and send it for you from France and send a copy to you by e-mail. This service is included in your package or invoiced in addition; postal charges in all cases at your expense.

All other legal and administrative services are subject to a preliminary quotation established by UBIDOCA and must be accepted in writing before any service.

2.4.6. Customer Calls

If we receive phone calls for you personally, you will be charged 15 € per month (UBIDCOA does not intend to act as a telephone switchboard for customers of its customers) regardless of the number of calls received.

2.4.7. Message Transmission

When a person, either professional or private, contacts Ubidoca (by phone or e-mail) to find one of our clients, Ubidoca will send to the client the person's contact details and the message they wish to send (by e-mail) Cost: 1.50 € / message transmitted.

 

Article 3.The forwarding of your original mails

3.1. The principle of redirection

Our premises are not accessible to the public for reasons of confidentiality and security. You can not pick up your mails in person or have them picked up by a third party.

The redirection of your original mails is done at least once a month on the anniversary date of your registration.

You can opt for a more frequent reshipment frequency: every 15 days, once a week or every day (working day). Depending on the case, these reshipments during the month are included in your package or invoiced in addition.

If you do not wish to receive your mails each month, you must opt for the Mail Storage service (invoiced 7 euros per month). Your mail will be archived for the length of time that suits you (several months or several years). They can be redirected to you on request and at the address of your choice.

If the weight of your mail in custody exceeds 10kg, the storage will be invoiced 14 € / month. You will be notified by e-mail when the weight of your mail reaches this limit.

If the weight of your mail in custody exceeds 20kg, the storage will be charged 20 € / month. You will be notified by e-mail when the weight of your mail reaches this limit.

If your mail can not be redirected to you 15 days after the end of a month due to a debit account or an insufficient balance to cover the costs of redirection, or due to the absence of a forwarding address, you will be charged costs for "Unplanned Custody" (8.50 € per month) and this, until regularization of your situation.

Exceptionally, and after reviewing your situation, UBIDOCA can destroy your original mail. This service is charged 3 € per month. To do this, you must send us a handwritten authorization to destroy your letters and a double-sided copy of your identity card. In this case, your mail will be archived for one (1) month. After this period, they will be systematically destroyed (without you being warned beforehand).

You can also ask us selective destruction punctually. Your client space allows you to select the mails you want us to destroy. A selective destruction is invoiced 3 € per request made in the same day, whatever the number of documents you wish to destroy.

It is up to you to evaluate the consequences of such destruction. Indeed, the legislation needs you to converse for several years certain letters and documents in their original version. UBIDOCA can not be held responsible if a document destroyed with your authorization was subsequently claimed by the administration or any other body in order to assert your rights.

Your original mails are redirected to you as received by UBIDOCA, that is to say in their original envelope or under plastic when they have not been opened (advertising, book, magazine).

If you do not want us to reship advertisements and promotional mails, you should opt for Mail sorting (invoiced 8 euros per month). Your mail will be redirected to you by the Post Office in tariff letter (in case of sending in France) or priority rate (in case of dispatch outside France). On request, UBIDOCA can forward your original mails:

  • In monitored letter
  • By registered letter
  • By private carrier

The costs of returning your originals are not included in any of the packages, because they depend on the weight, destination and mode of transport of your mail (see 2.3).

3.2. Practical arrangements for redirection

You must give us a redirecting address (in France or abroad, to your home or to a third party) when you register ("contact details" section of your Customer Area) or 30 days after your registration at the latest.

Otherwise, you will be charged for the month due because of "Unplanned Guard" (€ 8.50 per month) and the sending of your letters will be postponed by one (1) month or fifteen (15) days, depending on the scheduled frequency of your redirections.

You can change your forwarding address at any time in your Customer Area at no extra charge. As soon as you change it, it immediately replaces your old address.

Your original mails will be redirected to the address valid on the day of the redirection foreseen contractually. It is therefore up to you not to:

  • provide us with a return address not yet valid
  • leave in your Customer Area an outdated address

Article 4. Orders and regulations

4.1. Payment

Possible payment methods are:

  • Credit card via Paypal from your Customer Area
  • Bank or postal check
  • wire transfer
  • monthly direct debit
  • postal money

Online payment is secure. UBIDOCA uses the 256-bit SSL communication protocol to encrypt all data exchanged with your machine. SSL encrypted mode is in effect when one of the icons appears at the top of your browser.

The displayed prices are indicated in euros, all French taxes included (French VAT and other applicable taxes).

All the services ordered by the customer as well as the shipping costs are payable in advance.

The minimum payment by credit card is 10 euros.

Whichever method of payment is chosen, your payment takes the form of a refillable credit, which you renew, at your convenience, depending on the formula or price package chosen.

In case of online payment by credit card, you are re-directed to the Paypal site. Your Ubidoca account is credited upon your payment. You will receive a summary email of your payment. If you make your payment by credit card with an e-mail address other than the one entered during your registration, your Ubidoca account will not be credited automatically.

If you make your payment by check, money order, direct debit or by bank transfer, your account will only be credited after receiving your mail and / or payment from our account. You will receive a summary email of your payment as soon as your payment has been validated by our services.

Visa, Paypal, Postal money (Mandat Cash) and direct debit payments are subject to a commission when their amount is less than 50 euros. The scale applied is:

  • Visa and Paypal, amount: 0 to 10 €, commission: 0.54 €
  • Visa and Paypal, amount: from 11 to 20 €, commission: 0.78 €
  • Visa and Paypal, amount: from 21 to 50 €, commission: 1.17 €
  • Visa and Paypal, amount: from 51 to 500 €: free
  • Direct debit, amount: from 0 to 50 €, commission: 0.48 €
  • Direct debit, over € 51: free of charge
  • Postal money, amount: from 0 to 50 €, commission: 1.00 €
  • Postal money, amount over € 51: free
  • Payments by check: free
  • Payments by bank transfer: free

If you have opted for a debit payment, the first debit will be made within 7-10 working days of receipt of the necessary documents (debit authorization, ID card and Bank details).

In the event of a debit rejected by your bank, a management fee will be charged (15 €). The direct debits will be immediately interrupted and you will have to opt for another method of payment.

In case of a check rejected by your bank, a management fee will be charged (15 €).

In the event of a credit card payment incident, your Ubidoca account will be immediately closed. It can only be reactivated by payment by bank transfer; once your Ubidoca account is reactivated, you will need to pay your subscription by bank transfer or by check only.

In case of payment in foreign currency, a transaction fee will be charged if they have not been taken care of by your bank.

4.2. Practical arrangements

If you opt for a monthly plan, you must pay it before it expires. An e-mail of courtesy invites you to credit your account for the renewal of your pricing package.

Any subscription started is due. If you cancel your subscription during the month, it will not be refunded, regardless of the number of services performed by UBIDOCA during the month in question.

If you cancel your subscription during the month, and your balance is credited, the overpayment by UBIDOCA will be refunded to you on request, minus the monthly fee. The refund is made via Paypal for customers who have paid for their subscription by credit card, and by check or bank transfer for customers who have paid by bank transfer, direct debit, check or postal money.

When the balance of your UBIDOCA account is debit, we continue to receive your mails and / or to digitize them (in the limit of 11 unpaid documents put on line in your Customer Area). Since the mails can not be forwarded, a storage fee will be charged (€ 8.50 = unplanned mail custody)

Unpaid digitized mails can not be viewed on your Customer Area. You can unlock them instantly by paying online by credit card.

In case of a long debit balance, your account is suspended: your mails are no longer scanned or forwarded; the parcels are not forwarded. You are notified by e-mail of the receipt of couriers and / or parcels but of their non-processing. Your monthly fee will continue to be debited and storage fees will be charged: 8.50 € / month within the limit of 10kg of mail (beyond, the costs are 14 € / month) and 7 € / package / week. Once your account has been balanced, the processing of your letters and parcels resumes without delay.

You can change the pricing package during the month and opt for a superior package. If you wish to opt for a lower pricing package, you can only do so at the end of the current monthly plan.

4.3. Invoices

You can view your invoices for the last 12 months in your Customer Area. It is up to you to print them regularly

In accordance with French law, invoices issued by Ubidoca must include a billing address. You must therefore fill in this address in your Customer Area. If not, and after 3 reminders, 5 euros will be charged each week.

Invoices issued by UBIDOCA must mention the applicable VAT (rate + amount). No invoice without VAT can be established

Article 5. Termination of contract

5.1. Retraction

Pursuant to Article L. 121-20 of the Consumer Code, you have a right of withdrawal. This right must be exercised within seven (7) days from the date of registration at https://www.ubidoca.com/_en/. When the 7-day period expires on a Saturday, Sunday, or a French public holiday, it is extended to the next working day.

To exercise this right, you must send us an e-mail to Customer Service clearly stating your identity and your will to terminate the contract.

5.2.Termination and suspension

5.2.1. Under UBIDOCA initiative

UBIDOCA reserves the right to terminate or suspend, as of right, an account opened on https://www.ubidoca.com/_en/ , without right to compensation, in case of serious or renewed violation of one of the clauses of the present Terms and Conditions.

UBIDOCA also reserves the right to terminate or suspend, without notice, a customer account by sending an e-mail:

  • In case of prolonged delay in payment
  • In the event of a payment incident whether or not it is repeated
  • In the event of non-compliance with the terms of payment set out in these Terms and Conditions
  • In the event of non-compliance with the obligation set out in Article 2.1. of the present Terms and Conditions, concerning the mention Ubidoca Center
  • In the case of non-compliance with the obligation to communicate a billing address after more than three reminders
  • When the customer uses the services and address of UBIDOCA to purchase or sell goods on EBAY or on a similar site, moreover when the customer displays our address in such websites without prior authorization
  • When the customer uses the services and address of UBIDOCA for commercial purposes in areas that are subject to specific trade regulations (pharmaceuticals, chemicals, weapons, alcohol, tobacco, etc.).
  • When the commercial or professional activities of the client are detrimental to, or could be detrimental to, the nature or exercise of the UBIDOCA brand image
  • When UBIDOCA suspects a customer of defrauding or attempting to defraud on the Internet or violating French legislation
  • In the event of bad faith on the part of the client as to UBIDOCA malfunctions, difficulties in connecting to the Internet or its Customer Area, geographical location, messaging or personal problems, etc. in order not to pay for its subscription and its options (non-limiting list)
  • In the case of insults, defamatory remarks or threats (by mail, e-mail or telephone) to UBIDOCA and / or its personnel, the content of which remains at the discretion of the management of UBIDOCA.

If a customer whose account has been unilaterally closed by UBIDOCA for prolonged debit wishes to reactivate his account, he must make the request by e-mail. A management fee will then be charged (15 €) to reactivate his account.

UBIDOCA also reserves the right to terminate or suspend, without notice, a customer account by e-mail, in the event of civil or criminal prosecution (complaint, summons, request, order, etc.) brought against it and which involves (directly or indirectly) the company UBIDOCA, without the latter having to justify and / or produce any evidence to the client

If necessary, UBIDOCA reserves the right to charge the client thus sued:

  • In the case of the filing of documents (notice of official passage, summons, request, summons, etc.) by a bailiff on his premises (10 € per bailiff's visit)
  • In the event of a search on its premises with or without the assistance of the police force (100 € per hour)
  • In the event of the hearing of the manager of UBIDOCA (or one of its employees) required by the judicial or police authorities (50 € + traveling expenses according to the official tariff in force)
  • In case of documents to be transmitted by copy to the judicial or police authorities (1 € per photocopy + postage stamp)
  • In case of letters to be written and transmitted by mail or electronic mail to the judicial or police authorities (10 € by mail)

UBIDOCA reserves the right to take legal action against any client sued (irrespective of the outcome of the initial legal proceedings) in the event of financial and / or moral damage, direct or indirect, suffered in accordance with the laws in force

Inactive account for six (6) months, i.e. for which no scanning or redispatch has been performed and no services invoiced, will be automatically and unilaterally closed by UBIDOCA.

UAn account thus closed for inactivity for six (6) months may be reactivated at the request of the customer without loss of digitized mails in its Customer Area. In order to prevent the account from being closed again if it remains inactive, the customer can request the activation of the monthly package "Pending Package".

An account closed for inactivity for six (6) months that has not been reactivated at the request of the customer after the expiration of a new period of six (6) months will be purged: the scanned mails will be definitively erased.

5.2.2. At your initiative

You can cancel your account at any time. In this case, you must send an e-mail to Customer Service. As long as you have not canceled your account, we continue to receive your letters and packages and your pricing package (+ your options) will continue to be charged to you. No a posteriori cancellation shall be accepted. You must regularize your account so that it can be closed. Article 9. Practical information

9.1. Annual closure

UBIDOCA reserves the right to close its offices during the holiday season. You will be notified by e-mail several days before closing. During this closure, your mails and parcels are stored in our warehouse but are not processed (no digitization or redirection). The registered mails are put on delivery until signing and processing from us (they are not returned to the sender).

 

Article 10. Liability

UBIDOCA's services comply with French legislation.

UBIDOCA can not be held responsible for the suspension of its services in case of force majeure, in particular in the event of interruption of the service related to the transport and storage of information or your computer system.

Article 11. Applicable law and competent jurisdiction

Customers of UBIDOCA are deemed to buy in France and are therefore subject to French law. All orders placed on https://www.ubidoca.com/_en/ are subject to the French law in force.

In the event of a dispute, the French courts shall have exclusive jurisdiction.
